Terms and Conditions

Welcome to Clearwater. These Terms and Conditions ("Terms") govern your use of the Clearwater mobile application (the "App") and water delivery services ("Services") operated by Clearwater ("we", "us", or "our") in Accra, Ghana. By creating an account or using our Services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old to use the App and Services. By creating an account, you represent that you are at least 18 years of age and that the information you provide is accurate and complete.
2. Account Registration
- You register using your mobile phone number and verify it via a one-time passcode (OTP) sent by SMS.
- You are responsible for maintaining the security of your phone number and account.
- You must not share your account credentials or allow others to access your account.
- You agree to provide accurate delivery address information, including GPS coordinates, to enable successful deliveries.
3. Services
Clearwater provides on-demand water delivery services in the greater Accra metropolitan area. Through the App, you can:
- Place orders for water delivery to your registered address(es)
- Track the status of your delivery in real time
- Rate completed deliveries
- Manage your delivery addresses and payment methods
Service availability depends on your location within our service area, driver availability, and depot capacity. We reserve the right to decline or cancel orders that fall outside our service area.
4. Orders and Delivery
- All orders are subject to availability and service area restrictions.
- Once an order is placed and payment is confirmed, we will dispatch a driver to fulfill your delivery.
- Delivery times are estimates and may vary based on traffic, weather, and driver availability.
- You must ensure someone is available at the delivery address to receive the water. If delivery cannot be completed due to customer unavailability, additional charges or cancellation fees may apply.
- You are responsible for verifying the quantity and quality of water upon delivery and reporting any issues promptly through the App.
5. Pricing and Payment
- All prices are displayed in Ghana Cedis (GHS) and include applicable fees.
- Payment is required upfront before your order is processed. We do not offer cash-on-delivery.
- Payments are processed securely through Paystack using Mobile Money (MTN MoMo, Vodafone Cash, or AirtelTigo Money).
- We do not store your Mobile Money PIN. Payment credentials are handled by Paystack in accordance with their security standards.
- Prices may change at any time. The price displayed at the time you place your order is the price you will be charged.
6. Cancellations and Refunds
- You may cancel an order through the App before a driver has been dispatched for a full refund.
- If a driver has already been dispatched, cancellation fees may apply depending on the stage of delivery.
- Refunds are processed to your original payment method (Mobile Money) or as credit to your Clearwater account balance.
- If you receive a delivery that is short of the ordered volume, a credit will be applied to your account for the shortfall.
- We reserve the right to cancel orders due to unforeseen circumstances, in which case you will receive a full refund.
7. Credits
Clearwater may issue account credits for volume shortfalls, cancelled orders, or promotional offers. Credits are applied automatically to your next order and are non-transferable. Credits have no cash value and cannot be redeemed for cash. Upon account deletion, any remaining credit balance will be refunded to your Mobile Money account.
8. User Conduct
You agree not to:
- Provide false or misleading information, including inaccurate delivery addresses
- Use the App for any unlawful purpose
- Harass, threaten, or behave abusively toward delivery drivers or Clearwater staff
- Attempt to manipulate pricing, promotions, or referral programs
- Interfere with or disrupt the operation of the App or Services
- Create multiple accounts for the same person
We reserve the right to suspend or terminate your account if you violate these Terms.
9. SMS and Notifications
By creating an account, you consent to receive SMS messages for account verification (one-time passcodes) and transactional notifications related to your orders (e.g., driver assigned, delivery en route, delivery completed). Message frequency varies based on your usage. Message and data rates may apply. You can manage push notification preferences in your device settings. To stop receiving SMS, you may reply STOP to any message. Note that opting out of SMS will prevent you from logging into your account, as login requires OTP verification.
10. Intellectual Property
The App, including its design, features, content, and trademarks, is owned by Clearwater and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.
11. Limitation of Liability
- Clearwater provides the App and Services on an "as is" basis without warranties of any kind, express or implied.
- We are not liable for delays or failures in delivery caused by circumstances beyond our reasonable control, including traffic, weather, vehicle breakdowns, or network outages.
- Our total liability for any claim arising from your use of the Services shall not exceed the amount you paid for the specific order in question.
- We are not responsible for damage to your property caused by third-party delivery drivers, though we will work with you to resolve any such issues.
12. Account Termination
- You may delete your account at any time from the Profile screen in the App.
- Upon account deletion, all open orders are cancelled with a full refund, your remaining credit balance is refunded, and your login is disabled.
- We retain order and payment records after account deletion for legal and financial compliance purposes.
- We may suspend or terminate your account at any time for violation of these Terms, with or without notice.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes arising from these Terms or your use of the Services shall be resolved in the courts of Accra, Ghana.
